
Terms of Service Agreement
Before starting a project, we need to make sure we are on the same page so there aren't misunderstandings and to protect against fraud, so please take some time to read through these terms! Thank you.
CONTENT RESTRICTIONS
Requests for all services are selection based, not 'first come, first served'.
Due to high demand, the Artist can't accept all requests. If request was denied, the client may apply again on the next commissions opening.
The Artist has the right to refuse projects and requests according to their discernment and capabilities. Some content that the Artist will not be comfortable with representing include:

Underage
-
Excessively violent
-
Copying other's styles
-
Gender identities and cultures I feel I may not be able to accurately or authentically portray or represent well
TIMELINE AND PROCESS
Work completion requires 1 week minimum, and may take up to several months depending on each project.
Timeline depends on commission type, complexity, and workload.
Final deliverables are provided by the Artist using Google Drive.

REFUNDS AND ADDITIONAL CHARGES
Clients have the right to request a refund 2 months after deadlines if Work has not been delivered and there was no agreed upon amendment to the timeline.

Rush fee of at least +25% will be applied if necessary. Rush fee may increase up to +100% depending on deadline. Client’s commission will be prioritized and completed within the time period agreed upon.

The Artist may keep your commission private for one month without additional payment if requested before the project begins. Any period longer than one month requires an additional fee of 25%+ of the final price.

REVISIONS
Two revisions allowed per item shown to the Client during the process. (i.e. After line art, only minor revisions are allowed.)
Additional charges for excessive revisions may be required.
Revisions may affect progress and timeline.

COMMUNICATION
The Artist will use Twitter DMs / Discord DMs to communicate and track status updates on Trello board.
Communication channels may include Discord or Twitter private messages, Trello, or others according to Artist discretion.
Artist response time may vary, up to one week in order to provide better or more concrete updates.
RIGHTS & USAGE
Artist Rights
The Artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing, the Work and work in progress on websites, social media, portfolios, public broadcast channels (i.e. Twitch) and more.

Client Rights
Clients receive exclusive usage rights to the Work for personal and commercial use.

Personal use meaning: display on social media accounts for promotional purposes with no direct monetization, such as:

profile pictures, banners, and posts

print and framing in personal spaces

display as part of designs on websites and channels, excluding use in content of these websites or channels.
Commercial rights / Monetized content rights meaning: usage of Work on streams, videos and other content such as:

physical prints and products that are not for sale;

usage of the art for streaming;
-
Youtube Thumbnails
-
Patreon or any paid membership perks
-
Commercial Video Game
-
E-Book Cover
In case of design work for the definition of the Client's brand identity such as character design, logo design, vtuber model, and more, intellectual property rights of the designs and their likeness are exclusively granted to the Client for use, production and modification purposes, commercial and personal.
Commercial distribution license is included ONLY in dakimakura and mousepad illustration services.
In case Client wants to use 'Live2D Model Art' Work for physical prints and products that are for sale, permission from the Artist is required.
In case Client wants to use the Work for physical prints and products that are for sale, a commercial distribution license is required.
Additional charges for this type of license are typically +150% of the original cost but may depend on the production scale.
Client must not claim Work as their own and must credit Artist using their social tag/username/link at the instance of display of the Work or permanently on their websites, social media profiles, broadcast channels and so on.

Client must not edit or modify Work in any way without prior permission from the Artist. Meaning you can not redraw or reuse any part of commissioned illustration without my permission. Adding text/overlay/chat/special effects/etc over it is allowed.
Usage of Work for AI (artificial intelligence) tools, platforms or programs; ML (machine learning) tools, platforms or programs; AI or ML training; NFT; blockchain; or other for-profit platforms/purposes, is strictly prohibited.
PAYMENTS & FEES
Client pays at least 5% down payment for any project to secure a slot. The down payment is non-refundable. If the Client cancels their request, the down payment won’t be refunded.
The Artist offers payment plans. Amount of milestones can be chosen by Client. No time limit between payments but all payments have be made in order for Artist to send the final files.
All prices are in USD.
Prices may vary or change depending on complexity, requirements and/or additional requests.
Once Work has begun or payments have been made, the Client acknowledges Work and deliverables are digital and there are no physically shipped goods to receive.
The Client warrants they will not issue chargebacks and the refund policy will be followed.

CANCELLATION & REFUNDS
If the Client requests cancellation, a partial to full refund may be provided if cancelled within 2 days before work starts. (down payment is not included)
No refunds are possible after work begins unless initiated by the Artist.
If The Artist cannot complete work or there are delays for unforeseen reasons, the Client may be eligible for a full refund.
ACCEPTANCE
Client is 18+ and legally able to commit to an agreement.
Agreement date is upon first inquiry/communication or first transaction.
